Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Bright Nest Sitters website and services. By using this website, submitting a booking request, or creating an account, you agree to these Terms.
1. Who These Terms Apply To
These Terms apply to parents and legal guardians ("Clients"), babysitters and caregivers ("Sitters"), and all visitors, users, and account holders ("Users"). If you do not agree to these Terms, do not use the website or services.
2. Our Services
Bright Nest Sitters provides childcare booking and placement services. We help Clients request care and we coordinate sitter availability. Sitters are screened and assigned based on availability and the information you provide. We do not guarantee sitter availability, compatibility, or uninterrupted service.
3. Sitter Screening, CPR & First Aid
We require sitters to maintain current CPR and First Aid certification. Sitters may also be subject to screening procedures and checks consistent with our standards and applicable law. Certification and screening reduce risk, but do not eliminate it, and are not a guarantee of any specific outcome.
4. Insurance
Bright Nest Sitters maintains business liability insurance for company operations and sitters while performing assigned duties within the scope of a confirmed booking. Coverage does not extend to activities outside the agreed scope, undisclosed hazards, or unsafe conditions that were not reasonably known.
5. Client Responsibilities (Important)
Clients agree to provide accurate, complete information, including:
- Children's ages, needs, allergies, and medication requirements
- Emergency contacts and authorized pickups
- Care location details, access instructions, and safety information
- Pets in the home and any relevant behavior/safety notes
- Any in-home cameras or monitoring devices
If information is incomplete or inaccurate, it may impact sitter matching, service delivery, and liability coverage.
6. Emergencies & Medical Situations
Sitters are not medical professionals. In an emergency, sitters may contact emergency services, then contact the Client and/or emergency contacts. Clients authorize sitters to take reasonable steps necessary to protect a child's safety, including seeking emergency assistance.
7. Booking Changes, Cancellations, and No-Shows
Bookings are subject to sitter availability. Clients may be charged fees for late cancellations, last-minute changes, or no-shows. Bright Nest Sitters may cancel or reassign sitters due to safety concerns, operational needs, or circumstances outside our control.
8. Payment & Communication
Payment terms (including rates and fees) are determined by service type and booking details. Users agree to communicate respectfully with our staff and sitters. Harassment, unsafe behavior, or policy violations may result in termination of service.
9. Non-Solicitation (Protecting the Platform)
Clients agree not to solicit or hire sitters for off-platform work that bypasses Bright Nest Sitters. This protects sitter safety, insurance coverage, and the quality of service. Violations may result in termination of service and other remedies available under law.
10. Safety Expectations & Home Environment
Clients are responsible for maintaining a safe environment. This includes working smoke/CO detectors, reasonable childproofing, safe sleeping arrangements, and a home free from known hazards. Clients must disclose relevant risks or concerns before care begins.
11. Limitation of Liability
To the maximum extent permitted by law, Bright Nest Sitters is not liable for damages arising from events beyond our reasonable control, or from inaccurate information provided by Clients, or from actions outside a sitter's assigned duties and confirmed booking scope.
12. Indemnification
Clients agree to indemnify and hold harmless Bright Nest Sitters for claims arising from unsafe home conditions, misrepresentations, or failure to disclose information relevant to a booking.
13. Accounts & Security
If you create an account, you are responsible for maintaining account security and ensuring your login credentials are not shared. We may create account access options after a first booking to help manage ongoing care.
14. Termination of Service
We may suspend or terminate access for safety concerns, policy violations, misuse, harassment, or any behavior that threatens families, sitters, or the integrity of the platform.
15. Changes to These Terms
We may update these Terms from time to time. Continued use of the website or services after updates constitutes acceptance of the revised Terms.
